xAI Faces Lawsuit Over Unregulated Gas Turbines at Mississippi Data Center

Elon Musk’s artificial intelligence company, xAI, is facing legal action for operating nearly 50 natural gas turbines at its Colossus 2 data center in Mississippi without proper air pollution permits. The controversy centers on a regulatory loophole where the state classifies these turbines as 'mobile' because they are mounted on flatbed trailers, thereby exempting them from stationary source regulations for one year. The NAACP, represented by the Southern Environmental Law Center, has filed a lawsuit seeking an emergency injunction. They argue that this classification violates federal law, which stipulates that trailer-mounted power plants should still be considered stationary if they remain in one location. Plaintiffs contend that the unchecked emissions are significantly worsening air quality in an already polluted region near Memphis. While xAI initially received permits for only 15 turbines, reports indicate the number of operational units has risen to 46. This case highlights the growing environmental tensions surrounding the massive energy demands of AI infrastructure and the regulatory challenges posed by rapid technological expansion in industrial zones.
