xAI Adds 19 Unpermitted Gas Turbines Amid Clean Air Act Lawsuit

Elon Musk’s AI company, xAI, has installed 19 additional natural gas turbines at its data center in Southaven, Mississippi, bringing the total to 46 portable units. This expansion occurs despite an ongoing lawsuit filed by the NAACP alleging that xAI is violating the Clean Air Act by operating unpermitted methane generators. The legal action centers on the company’s Colossus 2 campus in South Memphis, where critics argue the emissions pose significant public health risks to nearby communities, particularly the predominantly Black neighborhood of Boxtown. Although xAI notified the Mississippi Department of Environmental Quality about the new installations, regulators classify the turbines as mobile, allowing them to operate for up to a year without specific air permits. However, plaintiffs contend these units should be legally defined as stationary sources, which would require strict permitting and pollution controls. The Southern Environmental Law Center supports the lawsuit, emphasizing the lack of transparency regarding emission toxicity and the disregard for local residents' health concerns. This development highlights growing tensions between rapid AI infrastructure deployment and environmental regulatory compliance in the United States.
