Enel Claims Nullity in Aneel Process, Cites Superior Service Indicators
Electricity concessionaire Enel has formally argued to Brazil's National Electric Energy Agency (Aneel) that the administrative process threatening its concession in São Paulo is null and void. In a 119-page defense, the Italian company contends that its service indicators for millions of customers in São Paulo's capital and metropolitan region exceed the national average. This legal maneuver follows Aneel's initiation of proceedings on April 7, 2026, after years of scrutiny regarding service quality and successive blackouts. Notably, a major outage in December 2025 left 4.4 million properties without power for over a week. Aneel criticized Enel's response as having low productivity and insufficient maintenance. However, Enel disputes these findings, alleging procedural defects and bias, claiming Aneel predetermined the outcome to break the contract. The company argues that the agency violated the principle of impersonality by adopting contradictory criteria. This dispute stems from ongoing issues since 2023, raising concerns about the future of Enel's concession in one of Brazil's most critical economic regions.
