Court Official Sues Ministry of Justice After Whistleblowing on Magistrate Hearing Cases from Portugal

Chris John, a former court legal adviser, is suing the UK Ministry of Justice for unfair dismissal, alleging retaliation after he exposed a magistrate conducting criminal hearings remotely from Portugal. John revealed that Magistrate Phil Taylor dialed into Single Justice Procedure (SJP) sessions at Reading Magistrates’ Court from his home near Lisbon, potentially invalidating thousands of convictions. Although pandemic-era rules temporarily allowed remote hearings, these provisions were withdrawn in 2022. John argued that continuing this practice without legal basis was unlawful and raised concerns about quotas for SJP cases. Despite senior officials concluding that magistrates should not dial in from outside the UK, John claims he faced bullying and was eventually sacked. He had reported the issue to Justice Secretary David Lammy and Courts Minister Sarah Sackman. The case highlights significant procedural irregularities within the UK judicial system, raising questions about the legality of past remote judgments and the treatment of whistleblowers who challenge administrative practices in the courts.
