CLARITY Act Could End ‘Coin Flip’ Crypto Enforcement, Helium Legal Chief Says
Sarah Aberg, chief legal officer at Nova Labs (Helium Network), argues that the proposed CLARITY Act would replace politically-driven crypto enforcement with durable rules classifying network tokens like HNT as digital commodities rather than securities. She cites the SEC's April 2025 dismissal of digital asset claims against Nova Labs—three months after suing over HNT distributions—as evidence of regulatory unpredictability. The Act would create a presumption that programmatic, non-discretionary token distributions are not securities transactions. Helium operates 140,000 hotspots and partners with T-Mobile and AT&T. Aberg notes that regulatory uncertainty diverts resources from infrastructure projects, including broadband pilots with public housing authorities in New York and California.
