California appeals court upholds Harvey Weinstein’s rape conviction, orders resentencing
A California appeals court upheld Harvey Weinstein's 2022 rape and sexual assault conviction on June 26, 2026, but ordered resentencing due to a trial judge error. The decision came a day after New York prosecutors dropped plans for a fourth trial after the accuser said she could not testify again. Weinstein, 74, was convicted in Los Angeles of raping and assaulting Italian model Evgeniya Chernyshova during the 2013 LA Italia Film Festival. He was sentenced to 16 years in prison. The appeals panel found the trial judge improperly limited defense questioning about Facebook messages between Chernyshova and a film festival head, which the defense argued would show she lied about their relationship. Weinstein's spokesperson said they will seek review by the California Supreme Court. Weinstein still faces a September sentencing in New York for a separate assault conviction, where prosecutors seek 20 years.
