Supreme Court Declines to Review Mass Transfer of West Bengal Officials Ahead of Elections

The Supreme Court of India has refused to entertain a petition challenging the Election Commission of India's (ECI) decision to transfer 63 Indian Police Service officers and 16 senior bureaucrats in West Bengal just days before the state assembly elections. The bench, led by Chief Justice Surya Kant, acknowledged that the case raised substantial legal questions but declined intervention due to the imminent polling schedule. Petitioners argued that the wholesale transfers, which included key figures like the Director General of Police and the Chief Secretary, were arbitrary and conducted under the guise of poll preparedness. They contended that these actions, taken without consulting the state government, violated constitutional provisions and federal principles, aiming to paralyze the local bureaucracy. The ECI also banned these transferred officers from holding election-sensitive posts. Despite allegations that the moves were mala fide and orchestrated by the central government, the court maintained that it was too late to review the administrative changes before the elections commence.
